NEW YORK (AP) \u2014 The New York attorney general\u2019s lawsuit against the National Rifle Association is no mere \u201cwitch hunt,\u201d a New York judge ruled Friday in dismissing the gun rights advocacy group\u2019s claims that the case is a political vendetta.<\/p>\n\n\n\n
Manhattan Judge Joel M. Cohen\u2019s decision means the nearly 2-year-long legal fight can continue.<\/p>\n\n\n\n
The ruling comes after mass shootings last month in New York and Texas reanimated debate over U.S. gun policy and refocused attention on the NRA.<\/p>\n\n\n\n
The New York case began when James, a Democrat, filed\u00a0a lawsuit that accused some top NRA executives of financial improprieties\u00a0and sought to dissolve the group. The attorney general\u2019s job includes oversight of nonprofit organizations incorporated in the New York, where the NRA was chartered in 1871.<\/p>\n\n\n\n
In March, Cohen\u00a0rebuffed James\u2019 bid to shutter the NRA. But the judge let the case go on, with the potential for fines or other remedies if the attorney general prevails.<\/p>\n\n\n\n
The NRA accused James in a court filing last year of waging \u201ca blatant and malicious retaliation campaign\u201d because of its views. The group sought to halt the lawsuit.<\/p>\n\n\n\n
Cohen rejected those arguments.<\/p>\n\n\n\n
\u201cThe narrative that the attorney general\u2019s investigation into these undeniably serious matters was nothing more than a politically motivated \u2014 and unconstitutional \u2014 witch hunt is simply not supported by the record,\u201d he wrote, noting that the probe was sparked by reports of misconduct and \u201cuncovered additional evidence.\u201d<\/p>\n\n\n\n
James applauded the decision, saying it confirms the suit\u2019s \u201clegitimacy and viability.\u201d<\/p>\n\n\n\n
\u201cOur fight for transparency and accountability will continue,\u201d she said in a statement.<\/p>\n\n\n\n
NRA lawyer William A. Brewer III said the group was disappointed but would keep fighting the case and still believes it was unfairly targeted.<\/p>\n\n\n\n
\u201cThe NRA believes the NYAG\u2019s pursuit was fueled by her opposition to the association and its First Amendment activities in support of the Second Amendment,\u201d he said in a statement, using an abbreviation for the attorney general\u2019s title.<\/p>\n\n\n\n
In the wake of the recent shootings in Buffalo, New York, and Uvalde, Texas, Congress is under renewed pressure to respond after years of partisan logjams over gun legislation.<\/p>\n\n\n\n
The House\u00a0has passed bills that would raise the age limit to buy semiautomatic weapons\u00a0and establish federal \u201cred flag\u201d laws, which allow for taking guns from people at extreme risk of harming themselves or others. Such initiatives traditionally have faltered in the Senate.<\/p>\n\n\n\n
Democratic and Republican senators have been talking about a framework for addressing the issue, but no agreement has been announced.<\/p>\n\n\n\n
The NRA \u2014 a longtime political force that has lost some influence amid financial scandals in recent years \u2014 has long insisted that mass shootings are no reason to limit access to guns, arguing that the solution instead is for law-abiding people to have firearms to defend themselves and others.<\/p>\n\n\n\n
The message was echoed at the group\u2019s\u00a0convention in Houston last month, days after a gunman killed 19 children and two teachers in Uvalde.<\/p>\n\n\n\n
Rallies calling for significant changes to gun laws\u00a0are planned in Washington and around the country this weekend and are expected to draw tens of thousands of people.<\/p>\n\n\n\n
Meanwhile, the Supreme Court also is caught up in the national tug of war over the place of guns in America. The justices are\u00a0expected soon to issue their most consequential gun ruling in more than a decade, potentially making it easier to be armed on the streets of New York and other large cities.<\/p>\n\n\n\n
