{"id":3856,"date":"2025-07-15T10:29:08","date_gmt":"2025-07-15T14:29:08","guid":{"rendered":"https:\/\/www.viewworld.org\/?p=3856"},"modified":"2025-07-15T10:29:09","modified_gmt":"2025-07-15T14:29:09","slug":"new-york-clerk-again-refuses-to-enforce-texas-judgment-against-doctor-who-provided-abortion-pills","status":"publish","type":"post","link":"https:\/\/www.viewworld.org\/?p=3856","title":{"rendered":"New York clerk again refuses to enforce Texas judgment against doctor who provided abortion pills"},"content":{"rendered":"\n<p>A county clerk in New York on Monday again refused to file&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-new-york-louisiana-b9d6a0c821fc444a609cf5cde70efaaa\">a more than $100,000 civil judgment from Texas<\/a>&nbsp;against a doctor accused of prescribing abortion pills to a Dallas-area woman.<\/p>\n\n\n\n<p>New York is among&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-ban-pills-states-shield-laws-nyc-7c05af01ce701357b009b531f7803ad9\">eight states with shield laws<\/a>&nbsp;that protect providers from other states\u2019 reach. Abortion opponents claim the laws violate a constitutional requirement that states respect the laws and legal judgments of other states.<\/p>\n\n\n\n<p>Republican Texas State Attorney General Ken Paxton wants a New York court to enforce a civil decision from Texas against Dr. Margaret Carpenter, who practices north of New York City in Ulster County, for allegedly prescribing abortion medication via telemedicine.<\/p>\n\n\n\n<p>Acting Ulster County Clerk Taylor Bruck in March&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-pills-lawsuit-texas-new-york-carpenter-e97d5c38d9429083d03c2a7b385cbbfd\">refused an initial request<\/a>&nbsp;to file the judgment, citing the New York law that shields abortion providers who serve patients in states with abortion bans. A second demand was made last week by the Texas attorney general\u2019s office, which said Bruck had a \u201cstatutory duty\u201d to make the filing under New York civil practice law.<\/p>\n\n\n\n<p>Bruck responded Monday that the rejection stands.<\/p>\n\n\n\n<p>\u201cWhile I\u2019m not entirely sure how things work in Texas, here in New York, a rejection means the matter is closed,\u201d Bruck wrote in a letter to Texas officials.<\/p>\n\n\n\n<p>An email seeking comment was sent to Paxton\u2019s office.<\/p>\n\n\n\n<p>The Texas case is one of two involving Carpenter that could end up testing shield laws.<\/p>\n\n\n\n<p>Democratic New York Gov. Kathy Hochul this year&nbsp;<a href=\"https:\/\/x.com\/GovKathyHochul\/status\/1892578137352921302\" target=\"_blank\" rel=\"noreferrer noopener\">invoked the state\u2019s shield law<\/a>&nbsp;in rejecting a request to extradite Carpenter to Louisiana, where the doctor was charged with&nbsp;<a href=\"https:\/\/apnews.com\/article\/abortion-indictment-lousiana-new-york-doctor-63ff4d9da8a9b592a7ca4ec7ba538cd3\">prescribing abortion pills<\/a>&nbsp;to a pregnant minor.<\/p>\n\n\n\n<p>Hochul, responding to the latest request from Paxton\u2019s office, claimed he was attempting to dictate \u201cthe personal decisions of women across America.\u201d<\/p>\n\n\n\n<p>\u201cOur response to their baseless claim is clear: no way in hell.
